Business rescue: Chapter 6 of the Companies Act 71 of 2008
Business rescue lets a financially distressed company — one unlikely to pay its debts in the next six months, or likely to become insolvent in that period — keep trading under the supervision of a licensed business rescue practitioner. It starts either by board resolution filed with CIPC (section 129) or by court order on application of an affected person (section 131), and brings a general moratorium on legal proceedings.
Because commencement by resolution is filed with CIPC and not gazetted, the Gazette shows mainly the court-driven side: orders placing a company in rescue, setting a resolution aside, discontinuing proceedings or converting them into liquidation. That is what this page collects.
Of these, 5 show a court order ending the rescue. A further 8 companies came out of business rescue into liquidation and are counted under liquidation.
